Determining auto liability is pretty straightforward most <br /> of the time, but what happens when someone else is driving your car at <br /> the time of the accident? &nbsp;Then, the rules of liability get a bit more <br /> complicated. &nbsp;We&#8217;ll provide you with a few different scenarios. <br /> 
<p>Scenario #1: Your Friend Drives Your Car With Permission and Crashes <br /> It <br /> 
<p>In the case of a minor accident, if both you and your friend have auto <br /> insurance, and there&#8217;s minimal damage to your car, it&#8217;s your insurance <br /> that will kick in first. &nbsp;You&#8217;ll also have to pay your deductible. &nbsp;If <br /> you give permission for a friend or relative to drive your car, then <br /> your policy will be the one to insure the vehicle. <br /> 
<p>Let&#8217;s say your friend with his own auto insurance causes a major <br /> accident resulting in serious property damage and bodily harm to <br /> another person. &nbsp;In this case, the driver&#8217;s policy should cover two <br /> parts: bodily injury liability and physical damage liability. &nbsp;Bodily <br /> injury liability covers the driver and all passengers in his car. <br /> Physical damage liability covers any damage to another car caused by <br /> the driver&#8217;s car, plus any legal fees that occur if you are sued. <br /> However, if your costs exceed the limits for which you are insured, <br /> the courts can attach personal assets like your house to recover the <br /> damages. <br /> 
<p>If your insured friend is at fault for the accident and the two of you <br /> decide to split the cost of the damages, it&#8217;s called &quot;pro-rata.&quot; &nbsp;You <br /> combine the amounts for which both of you are covered for property <br /> damages and then split the cost proportionately. <br /> 
<p>If your friend is uninsured and is at fault for the accident that <br /> causes damages that exceed your policy limits, then the injured party <br /> can place you responsible for property damage and medical expenses. <br /> So choose wisely hwen allowing your friends permission to drive your <br /> car. <br /> 
<p>Scenario #2: Your Friend Drives Your Car Without Permission and <br /> Crashes It <br /> 
<p>Most of the time, your insurance company will assume that you have <br /> given someone permission to drive your vehicle if they crash it. <br /> While difficult to prove, they will not hold you accountable if it&#8217;s <br /> clear that your permission was not granted (for example, your friend <br /> gets drunk and takes your car without you knowing it). <br /> 
<p>Scenario #3: Someone Steals Your Car and Crashes It <br /> 
<p>You will not be held responsible for any damages done to another car <br /> or its driver if someone steals your car. &nbsp;But be prepared to shell <br /> out some money for repairs. &nbsp;Your collision insurance will have to <br /> cover the damages to your own car. <br />

<p>ORLANDO, Fla. &#8212; PGA Tour player Arjun Atwal estimated he was going 80 <br /> mph in a 45-mph zone just before a car speeding next to him flipped <br /> and killed its driver, documents from the Florida Highway Patrol show. <br /> 
<p>Witnesses have said Atwal and John N. Park, who died, were street <br /> racing on March 10. No criminal charges have been filed, and troopers <br /> said Thursday it would be another month before the investigation is <br /> complete. <br /> 
<p>The highway patrol still hasn&#8217;t determined independently how fast <br /> Atwal and Park were going, but a preliminary report showed the golf <br /> pro estimated he was 35 mph over the limit. Witnesses said the two <br /> were going 100 mph. <br /> 
<p>Robert Kreusler, CEO of Blue Giraffe, the sports management company <br /> representing Atwal, would not comment on the estimated speed. However, <br /> Kreusler said: &quot;Arjun categorically denies that he was involved in any <br /> kind of racing or street racing.&quot; <br /> 
<p>Both drivers were in expensive, high-performance cars capable of <br /> incredible speeds: Atwal in a 2006 BMW M6 with a 500-horsepower <br /> engine, and Park in a 2006 Mercedes CLS 55 AMG with a 469-horsepower <br /> engine, according to highway patrol documents and vehicle registration <br /> information. <br /> 
<p>Trooper Kim Miller said there were no signs the cars touched each <br /> other. She said Park&#8217;s car lost control, veering off the road into a <br /> fence and small tree and flipping up to eight times. <br /> 
<p>&quot;You could actually see the spots that were dug into the grass,&quot; <br /> Miller said. &quot;As he&#8217;s going end-over-end, the car is just coming <br /> apart. It was a very violent crash.&quot; <br /> 
<p>After Park lost control, Atwal veered the other way off the divided <br /> four-lane highway, across the median and into the opposite lane of <br /> traffic, according to the highway patrol accident diagram. He did not <br /> hit any vehicles there, Miller said. <br /> 
<p>Miller said Atwal wasn&#8217;t tested for drugs or alcohol because it was <br /> obvious to crime scene investigators he wasn&#8217;t impaired. She said Park <br /> also was not believed to have been drinking. <br /> 
<p>Atwal&#8217;s representatives have said he did not previously know Park and <br /> was not at fault. The two were driving on a suburban road connecting <br /> the Walt Disney World resorts and upscale communities west of Orlando. <br /> 
<p>Atwal joined the PGA tour in 2003 as its first Indian-born player. He <br /> finished 140th last year on the money list, failing to keep full <br /> exempt status. </p>

<p>After I started getting a little ticked off about auto insurance I <br /> stumbled upon (literally, stumbleupon.com) a site where other people <br /> have had a lot of trouble too. The most compelling I would have to say <br /> is about a mother with twin baby girls. The insurance company didn&#8217;t <br /> want to replace the smashed sensor that deploys the airbags when you <br /> get into a wreck. Anyway, it&#8217;s worth checking out. It really makes me <br /> sick. <br />

<p>Here&#8217;s the setup: &nbsp;A T-intersection with a stop on the T-leg and the <br /> through leg to its left (looking at the intersection from the T). The <br /> other through leg of the T is blocked by an accident. &nbsp;Flashing <br /> lights, tow vehicles, the whole works. &nbsp;Idiot in an SUV is stopped at <br /> the stop sign on the through leg. &nbsp;I&#8217;m three cars (all SUVs, blocking <br /> much of my view) back. &nbsp; <br /> 
<p>At first, I think all traffic is stopped at the intersection or it&#8217;s <br /> being directed by the police (whose lights I can see). &nbsp;This situation <br /> holds for a few minutes. &nbsp;Then I see a couple of cars go around the <br /> stopped traffic (in the opposite lane) and make a right onto the <br /> T-leg, one nearly colliding with another car making the left off the <br /> T-leg. &nbsp;When nothing happens to them, I look up the leg of the T to <br /> make sure no one is coming, then do the same thing <br /> myself. <br /> 
<p>Sure enough, while the through leg is blocked completely and looks <br /> like it will be for a while, the T leg is completely open. &nbsp;There are <br /> no accident vehicles in the intersection; the crash is a bit further <br /> down. &nbsp;There is no one directing traffic. &nbsp;Ms. Moron in the SUV just <br /> decided that since she wanted to go straight, she&#8217;s just going to sit <br /> and wait for it to be clear, and to hell to everyone else behind her. <br /> I flipped her the appropriate gesture as I passed by, but I&#8217;m sure she <br /> was oblivious. <br /> &#8212; <br /> &nbsp; There&#8217;s no such thing as a free lunch, but certain accounting practices can <br /> &nbsp; result in a fully-depreciated one. </p>
